Timber Trespass
A timber trespass occurs
when a second party encroaches onto
another persons
wooded property and cuts down or removes
trees. This can happen during a timber
harvest where trees are harvested from
the neighboring property, during
building projects, placing a road
through wooded land, or while building
new homes and
subdivisions.
When
this happens the rightful owner of the
affected land and trees is entitled to
compensation. Typically a
consulting forester is hired to inspect
the damaged property. At this time
the forester will count, measure and
identify the cut or damaged trees and
will perform and appraisal on them.
The surrounding trees will be
inventoried to calculate original
stocking levels of the effected area.,
Other factors such as erosion control,
the placement of water bars, and
invasive species explosion may be
included. After the findings are
detailed in a report with the details
and costs, the forester may be required
to appear in court on behalf of the
client.
